General terms and conditions of sale Simples. ARTICLE ONE - Scope of application The applicable T&Cs are those in force on the day of the sale. ARTICLE 2 – Orders Mandatory information for the order to be taken into account: An order can only be validated if all the required fields are filled in by the customer. Any mistake made by the customer (in particular with regard to the customer's delivery address and telephone number) shall necessarily exonerate Simples. any failure, fault and liability in this respect. The client assumes sole responsibility for the information he indicates and the costs and consequences that this may entail. The re-routing of the order as is (the order returned to Simples due to the impossibility of delivery to an incorrect address or name) will be carried out by Simples., as soon as the customer has paid the re-routing costs. Product availability: The site indicates the availability of products for the items concerned by the online sale with regard to the number of which the order is desired by the customer. As a result, only items that are available at the time of ordering can be ordered. ARTICLE 3 – Invoicing and Payment The total invoiced price including VAT to be paid can be found in the order confirmation. A contribution to the shipping costs is charged in addition for an order from a customer, to be delivered in one go to an address in metropolitan France, of an amount less than € 66 including VAT. The shipping costs are mentioned on the invoice to be paid to validate the order. No discount is given. The payment must be made in full by credit card (and for the only ones mentioned on the site), PayPal, the only means of payment for online orders on the site. The online provision of the credit card number and the final validation of the order will be considered proof of the order and payment of the sums appearing on the order form. ARTICLE 4 – Withdrawal period The consumer customer has a period of fourteen clear days to exercise his right of withdrawal without having to justify any reasons. ARTICLE 5 – Liability Simples. is automatically liable to the Client for the proper performance of the obligations resulting from the contract concluded online, unless the improper performance or non-performance is attributable to the client, to the unforeseeable and insurmountable act of a third party to the contract or to force majeure. This provision does not apply to orders placed with another trader. In this case, the goods travel at the risk and peril of the customer, who is responsible, under the usual legal conditions, in the event of damage, loss or shortage, to make any reservations or to exercise any recourse with the responsible carriers, with a copy to Simples. ARTICLE 6 – Deliveries The site is active for any sale made under the conditions hereof and for delivery in metropolitan France unless agreed in writing with the customer for another destination. The delivery time will depend on the carrier chosen by the user as well as its destination. Delivery is made to the address indicated in this field on the purchase order by the customer. The delivery costs of parcels shipped over 3 kg in Europe, outside Europe and in the French overseas departments and territories will be the subject of a telephone call for an additional payment which will vary according to the excess weight. Be careful, however, for shipments in the French overseas departments and territories, if the volumetric weight is greater than 3 kg but not the weight in kilograms, the higher of the two will be taken into account. ARTICLE 7 – Reception The customer is obliged to check the conformity of the order and the delivered products with the order confirmation and the absence of any apparent defects upon receipt. ARTICLE 8 – Warranty Simple. guarantees, in accordance with the legal provisions, the customer, against any hidden defect, resulting from a defect in material, design or workmanship affecting the products delivered and rendering them unfit for the use for which they are designed. Any warranty is excluded in the event of misuse, application, negligence, abnormal storage and/or preservation conditions at the customer's premises. Simple. will only be liable for the replacement of defective or non-conforming goods, free of charge.
